1. About These Terms
These Terms & Conditions ("Terms") govern your use of the website deborahsmits.com and the purchase or download of any products or services offered by Deborah Smits ("I", "me", "my"). By accessing this website or obtaining a product — whether free or paid — you agree to these Terms in full.
These Terms are governed by the laws of the Netherlands. Where applicable, EU consumer protection law and the General Data Protection Regulation (GDPR) apply. International customers are also subject to these Terms; nothing herein limits any mandatory consumer rights you may hold under the laws of your own country.

2. Products & Services
I offer a range of digital and in-person products and services, including but not limited to:
Free products — Complimentary digital products available at no charge. By claiming a free product, you provide your name and email address, which I will use to deliver the product and to send you relevant updates and newsletters. You may unsubscribe at any time.
Digital programmes — Comprehensive online programmes delivered via the Kajabi platform. Unless stated otherwise at the time of purchase, access is granted for a defined period specified on the relevant offer page. Renewal options may be available at the price applicable at that time.
Women's circles & live events — Online or in-person gatherings offered as one-time or recurring experiences. Access or participation rights apply only to the specific session(s) purchased. No ongoing access to recordings or materials is guaranteed unless explicitly stated.
Other products and services — Additional offers, including order bumps, special launch prices, and future products, as presented on the website or at checkout from time to time. These are subject to these Terms unless specific terms are stated on the relevant offer page.
The specific access period, format, and any additional conditions for each product are described on the relevant offer or sales page at the time of purchase.
3. Payment Processing
Payments are processed securely through Plug & Pay in combination with Mollie as the payment service provider. I do not store your payment details; these are handled entirely by Mollie in accordance with their security standards (PCI-DSS compliant).
The following payment methods are accepted:
- iDEAL
- Credit card (Visa, Mastercard)
- PayPal
- Bancontact
- Other methods as made available through Mollie
All prices are listed in Euros (€) and are exclusive of VAT unless stated otherwise. VAT will be added where applicable under Dutch and EU law.
Current prices are listed on the relevant offer or sales page. Prices are subject to change. The price applicable at the time of your purchase is binding for that transaction. Special launch or promotional prices are valid only for the period explicitly stated.
4. Free Products & Email Communication
By claiming a free product, you agree that your name and email address will be stored and used to:
- Deliver the free product to you
- Send you relevant newsletters, updates, and offers from Deborah Smits
Your data is processed in accordance with my Privacy Policy and the GDPR. You may withdraw your consent and unsubscribe at any time via the unsubscribe link in any email.
5. Right of Withdrawal (Cooling-Off Period)
EU & EEA customers — digital products: Under EU Directive 2011/83/EU, you have the right to withdraw from a purchase within 14 days of completing your order, without giving a reason, provided you have not yet accessed or started using the digital content. By completing your purchase and accessing digital content, you expressly consent to the immediate performance of the digital service and acknowledge that you thereby waive your right of withdrawal once access has been granted.
EU & EEA customers — live events and women's circles: For in-person or live online events, the right of withdrawal expires upon confirmation of booking. Cancellation conditions are specified on the relevant offer page.
Customers outside the EU/EEA: No statutory right of withdrawal applies under Dutch law for digital products once access has been granted, or for event bookings once confirmed. Any refund requests will be considered at my sole discretion.
6. Refund Policy
Due to the digital and immediately accessible nature of my products, no refunds are granted once access has been provided or a booking confirmed, except where required by mandatory applicable law.
For live events and women's circles, any cancellation or refund conditions are stated on the relevant offer page at the time of booking.
If you experience a technical issue preventing access to a digital product, please contact me at [email protected] within 7 days of purchase and I will work to resolve it promptly.
Refunds for order bumps or optional offers purchased at checkout follow the same policy as the main product unless otherwise stated.
7. Access & Delivery
Digital products are delivered immediately upon completed checkout via the Kajabi platform. You will receive access instructions by email.
Live online events are accessible via a link sent to your registered email address prior to the event.
In-person events take place at the location and time specified on the offer page.
It is your responsibility to ensure that the email address and any other details you provide are accurate. I am not liable for non-delivery resulting from incorrect information provided at checkout.
The specific access period for each product is stated on the relevant offer page. I reserve the right to update, revise, or expand digital programme content during the access period. Removal of substantial content without replacement would entitle you to contact me to discuss a remedy.
8. Intellectual Property
All content on this website and within my products and programmes — including but not limited to texts, images, videos, audio, programme materials, event content, and design — is the intellectual property of Deborah Smits and is protected by Dutch and international copyright law.
You may not copy, reproduce, distribute, share, sell, or create derivative works from any content without my prior written consent. Personal use for your own learning and development is permitted. Sharing access credentials or programme content with third parties is strictly prohibited.
9. Disclaimer & Limitation of Liability
The content I provide — including all programme materials, event content, and communications — is intended for informational, educational, and personal development purposes only. It does not constitute medical, psychological, nutritional, or therapeutic advice.
You are solely responsible for your choices and actions in connection with using my products and attending my events. I am not liable for any direct, indirect, incidental, or consequential damages arising from your use of, or inability to use, my website, products, or services.
My total liability to you in connection with any purchase shall not exceed the amount you paid for that specific product or service.
Nothing in these Terms limits liability for death, personal injury, or fraud caused by my negligence, or any other liability that cannot be excluded under applicable law.
10. Privacy & Data Processing
Your personal data is processed in accordance with my Privacy Policy, available at deborahsmits.com/en/privacy. I comply with the General Data Protection Regulation (GDPR) and the Dutch Implementation Act (UAVG).
Payment data is processed by Mollie B.V., a licensed payment institution regulated by De Nederlandsche Bank (DNB). I do not have access to your full payment details.
11. Availability & Technical Issues
I strive to keep this website and the Kajabi platform accessible at all times, but I cannot guarantee uninterrupted availability. Scheduled maintenance or circumstances beyond my control may occasionally affect access. I am not liable for temporary unavailability of digital products or platforms.
For live events, I reserve the right to reschedule or cancel in exceptional circumstances. In such cases, I will offer an alternative date or, where no suitable alternative is available, a full refund.
12. Changes to These Terms
I reserve the right to update these Terms at any time. The version published on this website at the time of your purchase is the version that applies to that transaction. For future purchases, the Terms current at that time apply.
13. Governing Law & Disputes
These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or my products and services shall first be submitted to me directly at [email protected] for resolution. If we cannot reach a resolution, disputes may be submitted to the competent court in the Netherlands.
EU customers also have the right to use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

15. Online Events via Zoom
Online women's circles and live online events are hosted via Zoom. By registering for an online event, you agree to Zoom's Terms of Service and Privacy Policy (zoom.us/privacy). It is your responsibility to have a working internet connection and device.
Camera use
Camera use is encouraged but never mandatory.
Recordings
Sessions may be recorded for the purpose of making a replay available to participants. You will always be informed before a recording begins. If you do not wish to appear on camera in a recording, you may turn your camera off at that point. Recordings may be shared with participants of that specific session, or made available at a later date as a standalone product (free or paid) to a broader audience. You will always be informed of this intended use before the session begins, giving you the opportunity to keep your camera off if you prefer not to appear in a recording that will be shared more widely. Recordings are not used for marketing or promotional purposes without your explicit consent. If you have objections to being recorded, please notify me before the session.
